The Prothonotary / Clerk of Courts is a dual position because of the class Indiana County (sixth). The Prothonotary (which means first notary) is a clerk of the court of common pleas. The Prothonotary / Clerk of Courts keeps the records of all civil and criminal procedures before the courts, signs all writs and processes (such as suit), and keeps copies of all records and processes. The Prothonotary can also administer oaths and affirmations, and is also required by state law to maintain the judgment document. The Prothonotary is the Commonwealth’ agent for the collection of the tax on original writs and others received.
An important duty of the office is receiving petitions in connection with roads and rights of way, recording the action of members of boards of review, and eminent domain proceedings.
Services provided by the Prothonotary include recording divorce proceedings, acting as an agent of the Department of State to issue passports, and maintaining naturalization records filed from 1807 – 1958. Notary services are also provided. Persons seeking genealogical information frequently seek data from this office.
The office of clerks and courts is reputed to be the oldest office in the state. This officer acts as chief clerk and record keeper for the criminal courts.
